annulments-a ? on who can get one

I have a question regarding annulments.
If a non-catholic marries a non-catholic in a non-catholic church (but a Church, just the same) then divorces, then turns Catholic to re-marry, is it then possible to marry in a Catholic Church without getting an annulment?

My story is:
My brother-in-law was baptised Lutheran, married a baptised Lutheran in a Lutheran church, divorced her, and now wants to re-marry a Catholic in a Catholic Church in 3 weeks-he has completed RCIA and has become Catholic. He claims that he did not need an annulment for his first marriage due to the fact that his first marriage and divorce took place BEFORE he turned Catholic. He has been known to be a liar and is probably not telling the truth to his future wife and the church. I do know that he did tell us that he did file for an annulment, and now he has changed his story. By the way, his first wife was never contacting about an annulment, which sounds a little fishy to me.
I would like to know if he might be telling the truth about him not needing an annulment due to the fact that his first marriage was Lutheran and him being a non-catholic at the time.
